Personal information we collect– Information you provide to us directly — for example your name, contact details and the content of your message when you contact us through this website, by email or by telephone.
– Information collected in the course of providing financial services — including identity, financial, employment and, where relevant to insurance advice, health information, collected under our client engagement and statutory obligations.
– Technical information collected automatically when you use the website, such as browser type, device information and pages visited, including through cookies where applicable.
Why we process it and on what basis
– To respond to enquiries and arrange consultations —processed on the basis of steps taken at your request.
– To provide financial services under our engagement with you — processed to perform a contract and to comply with FAIS.
– To meet our legal obligations — including client due diligence, record-keeping and reporting under the Financial Intelligence CentreAct 38 of 2001 (FICA), FAIS and tax legislation.
– To protect our legitimate interests — including record-keeping for complaints handling and the defence of legal claims.
We do not sell personal information, and we do not send direct marketing without the consent or opt-out mechanisms POPIA requires.
Who we share it with
Personal information is shared only where necessary for the purposes above: with product providers and administrative platforms to implement your instructions; with our external compliance officer (Etude) in the performance of statutory compliance functions; with our professional advisers; and with regulators, including the Financial Sector Conduct Authority and the Financial Intelligence Centre, where the law requires it. All third parties who process personal information on our behalf are bound to appropriate confidentiality and security obligations.
Cross-border transfers
Where your instructions involve offshore investments or banking, relevant personal information may be transferred to product providers and institutions outside South Africa. We do so only as permitted by section 72 of POPIA — where the recipient is subject to laws or binding agreements providing an adequate level of protection, where the transfer is necessary to perform our engagement with you, or with your consent.
Security and retentionWe apply reasonable and appropriate technical and organisational measures to protect personal information against loss, unauthorised access and unlawful processing. We retain records for as long as the law requires: FAIS requires records of advice to be kept for at least five years, and FICA requires client due diligence and transaction records to be kept for at least five years from the end of the business relationship. Where no statutory period applies, we retain information only as long as necessary for the purposes described above.
Your rightsSubject to POPIA, you have theright to request access to the personal information we hold about you, to request correction or deletion of information that is inaccurate or unlawfullyheld, to object to processing, and to withdraw consent where processing is based on consent. Requests should be directed to our Information Officer. Our PAIA manual, available on request from our information officer, sets out the procedure for access requests.
